I'll confess: for several reasons I'm not following the Fitzgerald investigation as closely as many bloggers. The biggest one has to do with time; I just don't have enough to read all the fine detail people like Jane and Redd provide. But if I understand things correctly, Bush is now claiming that he declassified Plame's identity before "it got told" to Libby and the rest of the chain. Leaving aside the issue of Bush's right to declassify anything he wants, let's look at Fitz's own words. Hat tip to Plunger at the Americablog boards for pointing this out:
On October 28, 2005, a federal grand jury returned a five-count indictment charging
defendant I. Lewis “Scooter†Libby with obstruction of justice, perjury, and making false
statements to federal investigators, in violation of 18 U.S.C. §§ 1503, 1623 and 1001, in
connection with an investigation concerning the disclosure to reporters of then-classified
information regarding the employment of Valerie Plame Wilson.
Like I said, I'm not really the Fitzmas expert. But as Plunger noted, why would Fitz say that it was "then-classified" if he didn't have documentation to support that assertion?
