Obama to travel to see ill grandmother

this is not a "visit"--he's "rushing out there" and "suspending his campaign" and "she's gravely ill", etc -- except he's not--it's actually carefully scheduled and fit in so it doesn't affect swing states.

First, he owes Phil Berg nothing, because Phil Berg has filed a frivolous lawsuit and Obama has moved to dismiss it on the pleadings -- which means that he doesn't have to give Berg a damned thing unless and until the motion to dismiss is denied, which it hasn't been (nor has Berg's motion to deem the Requests for Admission to be admitted, though he's running around saying that Obama admitted a laundry list of stuff. But it's way, way premature for the RFAs).
Second, Phil Berg's allegations depend not so much on where Obama was born, but on his mother's marrying an Indonesian man and (allegedly) becoming a naturalized Indonesian citizen. He's citing the Nationality Act of 1940 in support of his allegation that Obama *lost* his citizenship when Stanley Ann Dunham remarried while Obama was a minor.
Berg places great stock in this as a disqualification, but a few minutes' research would reveal that the Nationality Act of 1940 was declared unconstitutional in 1967. Stanley Ann Dunham married Lolo Soetoro in 1967, and women hadn't automatically lost their citizenship upon marriage since the Cable Act in 1922. Berg's complaint doesn't specify what Dunham did to lose her citizenship, other than get married, which would of course be contrary to the holding of Afroyim and the Immigration and Naturalization Act of 1952, which eliminated any lingering women-lose-their-citizenship-upon-marriage stuff and applied the immigration laws equally to men and women). And because losing your citizenship requires a knowing and affirmative act, it's kind of hard for a kid to lose it because his mom got married.
Berg's a hack, basically, and I'm surprised to see him being cited with approval.
As for whether he was secretly born in Kenya, it doesn't matter. Stanley Ann Dunham was an American citizen, and she conferred that status on Barack Obama regardless of where he was born (just like John McCain's parents did the same for him when he was born in Panama.

But, I hope I wasn't the only one a bit disgusted by the "breaking news" banner on Yahoo. There are two seperate issues, here: Obama is going to visit an ill relative, and how the media has covered it. There was absolutely no reason for this to have been treated as "breaking news" on Yahoo. For his campaign schedule, this could have easily been treated as a passing new piece to alert folks that he'd be cancelling particular upcoming rallies. I think how the media treated this is a legitimate critique.
But, we've always been at war with Eastasia...
