Changes in the Constitutional Order

I can think of a few (although I wish somebody smarter than I am were hammering away at this framing on a daily basis):

1. Eliminating the Fourth Amendment and the gutting of the rule of law* through retroactive immunity for the telcos under FISA [cough] reform.

2. Placing 5-10% of the economy ($1 trillion+) under the unfettered authority of one former investment banker.

3. Unifying the legislative leadership of the two parties in service (at least) of the first two outcomes.**

Now, I understand that saying "mean things" on the Internet about Presidential candidates is very, very bad***, so I'll just ask a question:

Which Presidential candidate has been more instrumental in moving these changes in the Constitutional order forward?

NOTE * Except for little people. Naturellement.

NOTE ** This last change is not clear to me because of the sturm and drang of our day-to-day political process. But it looks to me very much like the two parties, from the 30,000 foot level, just are not that distinct -- especially when you throw Iraq into the mix. Even long-term trends like the composition of the judiciary or the civil service can be affected by these macro changes in the Constitutional order. For example, judges judge. If there is no rule of law, does that matter any more?

NOTE *** As opposed to saying mean things about ... Well, you can imagine. I won't mention it. I've gone through my stages of grief now. I'm fine. Really.

voting rights/protections too--

i am beyond disgusted that no one has done anything to help since 2000--and HAVA was horrendous.

Florida now -- http://www.miamiherald.com/news/politics... -- "... Palm Beach, for example, is one of only a handful of counties asking voters to connect a line between arrows rather than fill in the standardized test-style circle. Broward ballots will run four pages and come in 187 different styles to cover the myriad races. Miami-Dade's will print 58 different styles, from two to three pages, in three languages.
... In Palm Beach, meanwhile, the legal battle over the judicial race forced yet another limited recount last week. In a test a judge ordered Wednesday, two tabulators sorting just 262 ballots still being contested spit out different results -- though manual tallies added up...."

I found this interesting

Daniel Lazare's review of Laurence Tribe's latest book, The Invisible Constitution. Another chapter in the saga of how the Constitution simply means whatever it is they want it to mean.
