Either way, Paul and the Paultards have a problem. Let me explain:
1. If Paul did authorize the use of his image, then he’s now tied to a group indicted by the FBI for a money-laundering pyramid scheme. Attractive to a segment of the electorate, yes, but it would tie Paul way too close to classic Republican corruption for comfort.
2. If he did not authorize the use of his image, then:
a. Paul could sue NORFED, who distributed the coin, but that means suing his base.
b. However, if Paul does not sue… I’m guessing—any lawyers reading this please correct me—that if Paul doesn’t defend his image, it’s a lot like not defending a copyright or a trademark; you lose what you don’t defend. The EFF writes:
The right of publicity is a claim that you have used someone’s name or likeness to your commercial advantage without consent and resulting in injury. The plaintiff generally must prove that you’re using their image or likeness for advertising or other solicitations. Freedom of speech rights protect your use of a public figure’s name and likeness in a truthful way, but you can still be liable if a court determines that your use implied a false endorsement.
So, if Paul lets this one go, does he lose his right of publicity? I’m guessing yes. Maybe the Bunny Ranch could change its name to the Ron Paul Ranch? Not that there would be anything wrong with that.

No crime has been committed so watch your mouth.
No crime has been committed, no one charged, and no arrests have been made. Money was stolen by common criminals known as the government, as in Nazi Germany.
This company, like many others, has sold us gold and silver for 10 years now with no problem. There is no law against investing in silver and gold. No other companies have been ’raided’.
Any lawsuits will be directed against the feds for they are the ones who have done something illegal — it’s called stealing.
As for Paul, his likeness being on one of the pieces has no bearing on this except to give you a hint about why this was done… But then again, you are smart enough to know that….or are you?
Hey, give me a hint
No, I’m not smart enough. Or an expert in winger arcana, either.
“Watch your mouth” seems like a funny thing for a libertarian to say, though. Ari Fleischer, yes; libertarians, no. I guess this is a hint of the kind of state you guys really have in mind? ac
