The Senate Select Intelligence Committee is looking into allegations from two U.S. military linguists that the government routinely listened in on phone calls of American military and humanitarian aid workers serving overseas.

I'm shocked.

These are extremely disturbing allegations," said Committee Chairman Sen. Jay Rockefeller, D-W.Va., in a statement issued Thursday. "We have requested all relevant information from the Bush administration. Any time there is an allegation regarding abuse of the privacy and civil liberties of Americans it is a very serious matter."

Hey, Jay? I've got an idea!

How about we just give 'em all retroactive immunity?

Unless they already have it, of course.

NOTE I've really got to change the name of the book all these posts are in from "Bush warrantless surveillance" to "Surveillance" or, perhaps better, "Bipartisan surveillance."

Today's NSA Decision (leah, please read)

I can only get to leah's post by clicking on the link on this post and even then I can't comment. But I wanted to offer a couple of clarifications on the legal status.

The decision (link) was handed down in a U.S. District Court (not a circuit court, which are appellate in the federal system). Specifically, it was handed down in the U.S. District Court for the Eastern District of Michigan. The Eastern District of Michigan is in the 6th Circuit and so that's the appellate court it will go to first. Above that court is the Supreme Court. Given the "national security interests", I would not be surprised to see a rushed appellate process with probably a very quick briefing schedule and hearing. Or at the very least a request by the Government for the order not to be enforceable while it's on appeal (if they go this route, then the court's decision could signal its thinking).
