Horrifying that Republican operatives who happen to be lawyers are asserting that the executive--let's not use the word President, since that word applied in our Constitutional system--can interpret the law, and then not publish the interpretation.

Totalitarian Movements and Political Religions
Starting with Fraenkel's The Dual State (1941), based on the author's experience with the Nazi regime, this article examines to what extent the concept of the dual state can be applied to Italian Fascism. Elaborating on Carl Schmitts's concepts of mandatory and of absolute dictatorship, Fraenkel defines the dual state as an unifying complexity of structures and methods that combine normative and prerogative power. The dual state in Fascist Italy is an example, to almost the same degree, of emergency measures being undertaken to prepare the conditions necessary for the further development of a fascist revolution. abstract

...and so it came to pass in the latter days that any and all powers asserted to be held by the Executive Branch were in fact held entirely without remove, and any not asserted would be asserted and so held by the Executive Branch exclusively, especially as those powers arrive in a small, humorously painted car, filled with clowns, pouring out of the car, laughing and stumbling into some crazy heap in the middle of the Big Top, Teh Greatest Show On Earth.
