As long as Libby can stay out on bail, he suffers nothing that he and the rest of them won't tolerate. His legal bills are presumably all being covered, legally or illegally. So no incentive to pardon right away - unless he loses bail, in which case the pardon will come ASAP, and bad press be damned. (As if there will actually be much bad press when he gets the pardon. The national media has as much to cover up and make people forget about this case as Libby and the rest of them do.)

How likely is it that any of the others will be, or can be, indicted themselves between now and 2009? Not likely. There may still be some time left under the statutes of limitations for their crimes - both those we can imagine and those they actually know about themselves. And they may not be able to fire every prosecutor from here on out. But, all in all, the risk of indictment is small. Still, the longer the rest of them have to wait to get away with it, the longer Libby must be kept hopeful. And would he stop being hopeful once he gets his pardon?

Of course, Libby may well be enough of a "team player" that they can count on him never to start talking, or even threatening to talk, no matter how doubtful he may be of getting a pardon by January 2009. But he knows a pardon is in the bag, as long as he keeps his mouth shut; they know it, too; and he knows that they know, etc. And in any event, who's going to give him a better deal? His tell-all book can wait a few years.

As one of the main authorities on this subject once said, these things must be handled delicately.
