More than anything else, the Mukasey nomination is an indication of the Administration’s weakness. Now is not the time for complacency or satisfaction. Democrats must use this replacement opportunity to hold the Administration accountable for it’s malfeasance at the DOJ.

That’s what we need to do with Bush for this nomination which, let us recall, Bush never wanted to take place, because God knows what even a Republican who wasn’t insane or corrupt would dig up over at Justice.
But how?
The One Question is good. Are there other ways to stomp on Bush’s fingers as he tries to hold onto the edge of the cliff?

So the double-switch is complete, and Democrats can choose between confirming Mukasky in hopes of greater compliance (sure, that’ll happen) or delay the approval hearings and have the execrable Keisler in charge for the rest of the congressional session while they get beat up for “playing politics” and “denying the nominee a fair up-and-down vote.” The Senate is already holding up hearings on Keisler’s nomination to the DC Court of Appeals, another “Democrats are obstructionists” talking point.
Those subpoenas aren’t going to be satisfied any time soon, probably never. Perhaps a long, slow grilling of both Mukasky and Keisler is the best that can be had, keep them up and in front of the cameras on FISA and the attorney firings through November ’08. “Answer Yes or No - have you stopped breaking the law yet?” sort of thing.

There is absolutely no reason to install anyone in Justice who will NOT kick ass and take names. This Mucasy dude doesn’t seem the guy to do that. Why confirm anyone who will NOT do as the Senate bids?
