Department Have To OK New Florida, Michigan Mail Primaries?
In order to get them in and have ’em count by June 10, lawyers for Barack Obama say the answer, unequivocally, is yes.Here’s the reasoning: while a federal judge last year upheld the DNC’s right to interpret the rules of its own primary — even if those rules meant the technical disenfranchisement of an entire state of voters — the ruling did not touch on the form of the election itself.
When a party decides to change its rules in midstream, five counties in Florida and two counties in Michigan must ask the Department of Justice’s Voting Section to make sure that the new rules do not violate the rights of any aggreived minorities. Alternatively, they can ask a federal judge to bless the new rules, but that would take, at the very least, six months.
According to the Obama campaign, voting rights act provisions that govern pre-clearance requirements apply to primaries. So the Florida Democratic Party and the Michigan Democratic Party would be required to submit to the Justice Department their vote-by-mail procedures for close inspection.
The politics are oh-so-iffy. The Civil Rights Division of DoJ does not have a gleaming reputation among Democrats. Recall that [voter suppression expert] Hans Von Spakovsky, whose confirmation to the FEC the Democrats are holding up because of his record at the Justice Department, very much set the tone for the type of enforcement that the division has become known for over the fast few years.
“They don’t want to have to go to Michael Mukasey and ask him, ask Hans van Spakovsky’s voting rights section to make a decision on pre-clearance that could have an enormous ramification for the presidential nomination for the other party,” one of Obama’s lawyers said. [My goodness, why not?] “The party doesn’t also want to recognize that the DoJ has any formal regulatory authority.”
You know, when the _____ ers kept saying they wanted to bring Republicans into the party, I didn’t think the Republicans were going to be Justice Department officials. But hey, what could go wrong?
If the party decides to forgo pre-clearance and decides to take off without permission, well, lawsuits would block its path — from minority groups worried that the vote-by-mail process would disenfranchise African Americans.
A spokesperson for the DNC said the party was aware of the pre-clearance objection and was looking into it.
Aides to Hillary Clinton are, at my request, having lawyers look at the law and when they get back to me, I will get back to you.
I guess Carville won’t have to be coming up with that $15 million any time soon.
Of course, as tepid Obama supporter BTD points out, Obama himself sponsored a mail-in voting bill. I guess that was just for show, or to rack of the numbers of Mr. Hopey’s legislative “accomplishments”?
Whatever. I assume that Obama wouldn’t have introduced a mail-in voting bill that discriminated against anyone back then, and that makes the claims his lawyers are making now deeply bogus.
What a surprise.
NOTE Hey, I’ve got an idea! Instead of doing vote-by-mail, why don’t we disenfranchise people who have to work, the poor, the elderly, the sick, those with child care issues and those without cars by holding re-vote caucuses in FL and MI? That would certainly be more fair….

No Basis for a Lawsuit
Besides, I thought lawsuits over voting was bad. At least that’s what Team Obama told me when Texas and Nevada caucus systems were questioned.
I’m an election lawyer, but I can’t believe there’s any real basis for a lawsuit. As BTD has pointed out, there isn’t any more basis for a lawsuit by Obama challenging a re-vote than there was by Florida Democrats challenging the initial de-seating. Parties have a tremendous amount of leeway in how they select their delegates and candidates. If they didn’t, we wouldn’t have caucuses. And if caucuses pass constitutional muster, then you know a mail-in vote is going to.
Of course anyone who pays a filing fee and fills out a complaint can file a lawsuit, winning one is another matter. A lawsuit, no matter how frivolous, could delay matters, which I suspect is Obama’s entire strategy for this issue.

By the way, where was the uproar over these voters not getting their say in January?? It was not an uproar, because Hilary thought this election would be over by the end of the first week of February.
Now that she could lose, it is about the poor voters of Michigan and Florida. Well many people are not allowed to vote in primaries in many states if they are not affiliated with a party. Where is the outrage of these voters being disenfranchised. Democrats and Republicans like to exclude unaffiliated voters, but they sure believe in making them chip in, when paying for the public financing of their campaigns and to run their primaries.
Tell that cheap bastard Howard Dean to fix this mess and have the DNC put this together. If the Dems lose the white house, because Michigan and Florida vote republican this election and it elevates McCain into the White House. Point the finger at Howard fucking Dean.
As far as voting in the mail??? What next an internet vote?? Have you ever heard of the concept of a fraud risk factor??? The avenues for fraud go up substantially in this scheme. Whenever something costs more, there usually is a logical reason for it. It is usually better. With the exception of the horrific Bush prescription drug plan, which was a handout to insurance and pharmaceutical industries.
