I've seen some wonder if he would be Obama's first Supreme Court nominee (assuming he gets one). Given his defense of Bush's executive power theories, that would be... unfortunate.
It's difficult to tell where he stands on abortion. He's criticized Roe's reasoning and indicated he would've struck down the statutes at issue in Roe and Doe, but only because they were "overbroad" and that saying more than that would go against his minimalist beliefs about how the Supreme Court should rule. On the other hand, he's said some encouraging things about Ginsburg's dissent in the partial-birth abortion case (Carhart II), which sought to base abortion rights on gender equality. Although this later position of resting Roe on gender equality would seem to conflict with his argument for minimalist Supreme Court decisions.
I have never understood
how letting obvious criminals off the hook and allowed to ride off into the sunset without any accountability constitutes any part of "progressivism" but I'm sure the Flying Monkeys from the Cheeto will be happy to educate me in the most profane manner possible.
Explain that part about "better than McCain" again

"But McCain is so bad." That is a subtle but convenient difference. Since McCain is so bad, Obama can walk back on the issues and McCain will still be bad.
Notice the faux logic that is possible: McCain is so bad. Obama is not McCain. Therefore Obama is not so bad. When said fast it almost sounds valid. The "logic" demands a demonization of McCain rather than any direct comparison. I'm not saying this is true or its always used, but an absence of direct comparison is an easy way to let Obama off the hook for transitioning to the right.

We know McCain is bad
but so is Obama.
We need better choices.
