Stupid Roe argument

I keep hearing the OFB talking point that a key reason to vote for Obama in the general is to safeguard Roe.

If McCain won -- if Satan himself won -- Democrats would still have control of the SJC. If Dems really want to safeguard Roe, then make Roe a litmus test for the nominees. Then bork whoever gets sent up 'til McCain -- or Satan -- gets it and does the right thing.

Of course, that would require the Senate Dems to acquire stones, but that would be bad why?

There are plenty of other reasons to vote for the Democrat in the general, but this is not one.

NOTE In addition, vote the base. Obama doesn't have the base among women that Hillary does, so it follows that Roe would never be at the top of his list anyhow. Same deal with universal health care, for that matter. Or Social Security.

It's up to Congress to kill or allow horrible judges, so it's no good anymore to use the Supremes (as i have been doing for years and years) as the reason why we have to stay Dem--it's not a good enough reason anymore, especially now.

If Roe is overturned

Abortion is back in play for voters, and the majority of Americans are pro-choice.

Roe means the GOP can demogogue on the issue without consequence.

this election is about whether we attack Iran, whether they close the border, and whether we remain a democracy.

also, if Obama loses the Clinton wing of the party will be hated the way Nader is hated.

I am not asking anyone to support Obama if they really can't stand him. Just blog about other things.

There's one problem with the "Clinton Wing" argument

Nader received 2.7% of the vote in 2000. It was enough to cause Bush it "win" - wink, wink, nod, nod.

Clinton is getting approximately HALF of the voters in the primary. You can decide to hate and shun them all you want, but you have no coalition without them.

The SCOTUS Won't Influence My Vote For Obama

since I'm not convinced that he will not use SCOTUS to prove his bipartisan creds. Don't see any strong support for Choice in any of his primary rhetoric.

that democratic politicians would have to come out strongly on abortion rights, no more trying to play both sides knowing only one side will vote the issue so long as Roe protects them from angry pro-choicers.

Having said that, I'm not in favor of destroying Roe to save it for reasons I explained in the comments to my earlier post. But, I'm also not in favor of it being held like a gun to women's heads to keep us in line. Either defend it or face the electoral consequences. I reject any argument that essentially expects me to give up all political power in return for protecting the integrity of my body. Roe is supposed to empower me, not imprison me.

Besides, as amberglow points out, the Democrats already gave the conservatives a majority on the Supreme Court when enough of them went along with cloture for the Alito appointment. O'Connor was the swing vote and she's been replaced by a man with a horrible record on women's issues. That ship has sailed.

I remember when the Democratic Lege in California

would annually pass bills cutting off funding for abortion for poor women, the Gov would sign them, and Planned Parenthood would immediately file suit, get an injunction, and ultimately prevail.

It was a kabuki dance so the politicians could cover there butts on the issue.

Roe meant that the GOP could court the fundies for decades without ever having to deliver.

With Roe in place, even feminists had higher priorities, like ending discrimination. Pro-choice moderates could justify voting for Reagan and other reactionaries because Roe was a firewall.

Roe was a judicial decision that prevented us from reaching a political consensus on the issue. Instead we argue endlessly.

If the Democratic Senate finally wakes up, goes "obstructionist" and tries to ruin McCain's Man Date, there will not be one single independent voice arguing for them on the teevee. I'd much rather see this done in a one-party fashion, Rove style. And have all the nominees be younger than Roberts. And female.
