Tell me again why we regard the Bush Court as legitimate?

Via the Crack Den, the normally mild-mannered Brad DeLong brings the Shrill:

Ummm... Jeffrey [Toobin]--

You write:

Bush v. Gore may be an exception to this pattern. This may be the case where there was subterfuge. The opinion of the majority was so different from their customary views on important subjects – like Federalism and equal protection – that it is reasonable to conclude that the decision was little more than an attempt to seal the election for the Republican.

Jeffrey: I count two "mays," a "reasonable," and a "little more."

Are you *that* scared of writing: "Bush v. Gore is an exception. The opinion of the majority was do different from their normal views that nobody not a Republican hack can argue that the decision was anything other than a successful stealing of the election for the Republican"?

DeLong is right. In the light of what we know now about how the Conservative movement operates, it's crystal clear what went down:

Scalia et al have long wanted to impose their jurisprudence on the country. But they didn't have the votes on the Court to get that done. They knew they'd only get get the votes with a Republican President. So they wrote Bush v. Gore with that outcome in mind. (Which is why they were careful to make it a "good for one time only" decision. Wouldn't want to make the case a precedent, in case a Democrat ever wanted to use it.)

And so they got what they wanted: They selected Bush, and in due course Bush put Roberts and Scalito on the Court.

But Roberts and Scalito on the court wouldn't have happened without Bush v. Gore to begin with.

To me, that means we don't have a Supreme Court. We have a Bush Court. And every decision they've made since Bush's first nominee, Roberts, was installed, is fruit of the poisonous tree that was Bush v. Gore, and hence illegitimate.

Because he won the

Because he won the election.

How do you figure that?

And which election are you talking about?
The votes in Florida were never completely counted, because of the yuppie rioters in Miami-Dade County among other reasons. In 2004 the voters couldn't even cast their votes because the machines in Ohio were so screwed up.

Then don’t let

Then don't let Democrat's run the election.

Ah, when did Kathryn Harris

switch parties, dude?

Broward county.

Broward county.

Yeah, so? It was in Florida, right?

Harris was still the next level of appeal.
Or is that fact immaterial to you?

Actually, you could have

Actually, you could have ran the election a 100 ways, and Al Gore would have still lost, thank GOD.

Gotta be a bot.

No real human could be that dumb on that many subjects without hurting itself.

Bush won the election, fare

Bush won the election, fare and square. We all know that. If Al Gore had won, Sarah would be wearing a burka by now.

BBQ Pulled Pork

6 cloves garlic, minced or crushed
2 tablespoons olive oil
1 cup heinz 57
1 tablespoon chili powder
2 teaspoons crushed pepper

1/2 cup apple cider vinegar
1/2 teaspoon of liquid smoke

slice the onions and saute in oil over medium heat until soft; add garlic and stir for a few minutes

add all the rest of the ingredients and let simmer for a few minutes

pour over the trimmed pork shoulder; cook over low heat in your crock-pot about 10 hours.

pull pork apart with two forks, and serve on buns

cole slaw complements it all nicely

Lambert, not only is Bush V. Gore an exception

it's *the* exception.

Even the court that wrote it considered it dishonest.

Gotta believe that there's something hinky in the background. James "fixer" Baker didn't go down to Florida to let W get beat.

Gore won the popular vote, I believe, in 2000. I also think that he won the Florida vote, and would have been confirmed in the Senate and sworn in as President in 2001 in an honest, open society.

So there's that. We haven't lived in an honest, open society since at least 2000.

Admitting there's a problem is the first step to a solution.

The 2nd step to the solution is defining the actions to be taken to stop the spread of the problem.

At this point, I think nothing short of impeachment will do.

And I have or had respect for Toobin, too

His book on Whitewater was reasonable enough, as I recall. And anybody who writes for the New Yorker is writing for the only publication strong-minded enought to publish Seymour Hersh...

So it's a shame, and points to the increasing irreality of elite opinion; part of the process CD alludes to here.

A excerpt:

One of the fascinating questions about the Valerie Plame affair is why Joseph Wilson lied about his wife's role in sending him on that mission to investigate the Iraq-uranium link. In his own book, ironically titled, The Politics of Truth, Wilson admits that if she played such a role, that might be a violation of federal nepotism laws.
