From NYT:
PORTLAND, Ore. (AP) — Two provisions of the USA Patriot Act are unconstitutional because they allow search warrants to be issued without a showing of probable cause, a federal judge ruled Wednesday.
U.S. District Judge Ann Aiken ruled that the Foreign Intelligence Surveillance Act, as amended by the Patriot Act, “now permits the executive branch of government to conduct surveillance and searches of American citizens without satisfying the probable cause requirements of the Fourth Amendment.”
Score one for the Constitution!
More:
“For over 200 years, this Nation has adhered to the rule of law — with unparalleled success. A shift to a Nation based on extra-constitutional authority is prohibited, as well as ill-advised,” Judge Aiken wrote.
When I locate the decision text, I’ll post more.

…And before I post the parts I like and want to comment on…
The Bill of Rights is a born rebel. It reeks with sedition. In every clause it shakes its fist in the face of constituted authority… . it is the one guaranty of human freedom to the American people. - Frank Irving Cobb
Thank you, judge Aiken
And may a Democratic President nominate her for the Supreme Court.
That’s some text.
Makes you wonder if this case coming down was the real reason Bush stampeded Congress into gutting FISA….
