Barack Obama's incoming administration is unlikely to bring criminal charges against government workers who authorized or used harsh interrogation techniques [torture] during the George W. Bush presidency. Obama, who has criticized the use of torture, is being urged by some constitutional scholars and humans rights groups to investigate possible war crimes by the Bush administration.

But two Obama advisers said there's little — if any — chance that the incoming president's Justice Department will go after anyone involved in authorizing or carrying out interrogations that provoked worldwide outrage.

The advisers spoke on condition of anonymity because the plans are still tentative. A spokesman for Obama's transition team did not respond to requests for comment Monday.

Additionally, the question of whether to prosecute may never become an issue if Bush issues pre-emptive pardons to protect those involved.

There you go. This story is a trial balloon from the two Obama advisors! They want Bush to make this problem go away for them!

UPDATE Hilariously, McCain and Obama just met and agreed to work together to fix the Village's "bad habits". I kid you not. What bad habits do they have in mind? Torture, for example?

One of the processes that's worried me over the last eight years is the way we prepare for Bush to do outrageous things (like, say blanket pardons). They start off as "paranoia", we're assured that no one would do something like that, then people produce the arguments for why it could happen and even be legitimate, and next thing we know it's a fait accompli and the Villagers have already decided it's old news, everyone knew it was coming/happening, and it's not worth discussing. What a pity we can't send out the meme with such effectiveness that if Bush pardons everyone, we'll have no choice but to hand him and them over to the international courts.

Failure to investigate Reagan led to Bush

I wonder what the failure to fully investigate the criminality of Bush will lead to. Even if Obama is the saintly one so many have him claimed to be and won't dare abuse his imperial powers, the next president after him will indeed be mortal and more than capable of being corrupted by those powers. He'll, it's a guarantee they will be corrupted by such awesome power.

Prosecution is also what civilized societies do to avoid revenge

The alternative to prosecution is not doing nothing, it's revenge. The cycle of revenge never ends. That is why civilized societies have courts and prosecute criminals. We pay attention to the victims, and we punish the criminals, but this is really about a just society where the Hatfields and McCoys don't start killing each other to the last warrior.
